1. Acceptance of these terms
By accessing or using clouderm.com (the "Site"), you agree to these Terms of Use. If you do not agree, do not use the Site. We may update these terms from time to time; the Effective Date at the top reflects the most recent revision, and continued use of the Site after a revision constitutes acceptance of the revised terms.
2. What the Site is
The Site provides public information about CloudERM and InspectERM, including product descriptions, pricing summaries, and a way to request a demo or contact us. The Site is not the CloudERM application itself; the application is accessed at a separate authenticated domain and is governed by the CloudERM service agreement executed between CloudERM and the customer organization.
3. Acceptable use
When using the Site, you agree not to:
- Reverse-engineer, decompile, or attempt to extract source code from any client-side asset served by the Site.
- Use automated tools (crawlers, scrapers) to access the Site in a manner that imposes an unreasonable load on our infrastructure.
- Submit information through any form on the Site that you do not have the right to share (including confidential third-party data).
- Attempt to gain unauthorized access to any account, system, or data on the Site.
- Use the Site for any purpose that is unlawful in your jurisdiction.
4. Information you submit
When you submit information through a form on the Site (for example, the demo request form), you grant CloudERM the right to use that information to respond to your request, schedule any follow-up communication, and improve the Site. We handle the data per the Privacy Policy.
5. Intellectual property
The Site and its content — including text, product screenshots, logos, layouts, and code — are the property of CloudERM and its licensors and are protected by copyright and other intellectual-property laws. You may view, share, and link to public pages on the Site for non-commercial purposes; you may not reproduce, redistribute, or create derivative works from Site content without prior written permission.
6. Third-party links
The Site may contain links to third-party websites (for example, the iOS App Store, Google Play, our documentation site). We do not control and are not responsible for the content, policies, or practices of any third-party site. Following a link to a third-party site means you are subject to that site's terms and privacy policy.
7. Disclaimer of warranties
The Site is provided "as is" and "as available." To the maximum extent permitted by applicable law, CloudERM disclaims all warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. The product descriptions, pricing examples, and feature claims on the Site are informational and do not constitute a binding offer or guarantee of specific functionality.
8. Limitation of liability
To the maximum extent permitted by applicable law, CloudERM and its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Site. Nothing in these terms limits liability that cannot be limited under applicable law.
9. Changes to these terms
We may update these Terms of Use to reflect changes to the Site, our practices, or applicable law. When we do, we will update the Effective Date at the top of this page. For material changes, we may provide additional notice (for example, a banner on the Site) where reasonably possible.
10. Governing law
These Terms of Use are governed by the laws of the jurisdiction in which CloudERM is incorporated, without regard to conflict-of-laws principles. Any dispute arising from your use of the Site will be resolved in the courts of that jurisdiction, unless an applicable consumer-protection law requires otherwise.
